This subject is only available to students enrolled in the programs offered by the Office of the Environment. Melbourne Law Masters students are not permitted to take this subject.

Note:
Objectives

A candidate who has successfully completed the subject should:

  • Have developed an appreciation of the philosophical underpinnings of environmental law and the way in which the law understands the environment
  • Have an understanding of the relationship between science and law in the environmental field, and the legal application of concepts like the precautionary principle
  • Gain an understanding of State/Federal dynamics in the field of environmental regulation in Australia and a basic working knowledge of the principal federal environmental impact legislation
  • Develop an appreciation of the interrelationship between national and international environmental law.
Syllabus

Principal topics will include:

  • Legal understandings of the enviroment
  • Science/law interactions in environmental law
  • Legal regulation of the environmental impact of development
  • The international dimension of environmental regulation
